Promising does not mean moving in

In November 2017, the Governor of the Krasnodar Territory, Veniamin Kondratyev, was indignant that the problem of defrauded shareholders had been going on since 2005, and said that now it was not promising to look for those to blame, this would not lead to a solution to the problem. The governor decided to start with a clean slate and ordered that the situation be fully resolved by 2020.

Already V 2018at Kondratyev said that the region had adopted a law on compensation for investors. The head of the region expressed confidence that by joint efforts by 2020 the problem with defrauded shareholders will be completely resolved.

In September 2020, the time came to re-elect Kondratiev as governor of the Krasnodar Territory. He was re-elected, and upon taking office, he again promised to solve the problem of defrauded shareholders, but by 2023. At the same time, he did not forget to note his successes in solving a complex problem. And indeed, there was something to be proud of, the number of defrauded shareholders in the five years he spent Kondratiev in power has increased manifold.

Earlier, in March 2023, the authorities announced that there were 275 unfinished construction projects left in the region. At the same time, now the problematic house has begun to be entered into the register, even if the delay in commissioning is only one day. And five years ago, the list included only objects where construction had completely stopped or the developer went bankrupt. Thus, our explanations of why there suddenly became more shareholders, but promises were not fulfilled.

For several years now, the Kuban authorities have been trying to solve the problem with defrauded shareholders in the region, but the deadlines are constantly being pushed back. First, Governor Veniamin Kondratyev ordered to sort out the situation by 2020, then – to completely resolve the issue by 2023. The deadline was announced on the direct line of the head of the region, which took place in January of this year. Veniamin Kondratiev said that “at the end of 2023, we must turn the page with deceived shareholders once and for all.” Now the deadline has been postponed to 2024. But these are all words that everyone has long been tired of and no longer believes. It is obvious that in reality the Kuban government is taking the path of aggravating the problem.

The current mayor of Krasnodar, Evgeniy Naumov, gave similar assurances that the problem would be resolved soon.

On September 28, journalists published a fragment of an interview with the head of the city, where he named new deadlines for solving the pressing problem of shareholders. According to Naumov, at the end of September there were 40 problematic objects left in the center of the region (remember that he mentioned the same figure in June, that is, nothing has been done).

“Shareholders of 12 long-term construction projects will receive compensation, the remaining 28 problematic objects will be completed in 2024,” RIA Novosti: Krasnodar quotes the mayor.

The situation is similar in many cities of the Krasnodar Territory. This has acutely affected not only the regional center; resort towns are experiencing great difficulties. An example is the fight against the so-called unauthorized construction at the country’s main resort in Sochi. The administration is filing lawsuits for the demolition of apartment buildings in which people have lived for years and which were put into operation by court decision. “This scheme legitimized half of Sochi,” states the Sochi1.Ru portal. This was the path that the administration itself imposed on developers. Only this turned out to be not enough; previously issued construction permits were revoked in an unprecedented manner, and those issued by the Sochi administration itself.

The publication lists the constructed apartment complexes: a house on Deputatskaya, 10, by the developer SochiStroy – ARD, a facility in Tenevoy Lane by the developer Zodchiy LLC, the third stage of construction of the Three Captains residential complex, the second stage of construction of the Morskaya Symphony residential complex by the developer Monolit LLC “, LLC “SZ “Margo”” MFC “Imeretinskie Heights”, four letters, two houses of the developer LLC “Ida”, located on Gagarina, 53a and on Pasechnaya, the second stage of the residential complex in the Bytha microdistrict of the developer “MVM-group”, etc.

The situation with the dismantling of illegally built residential complexes in Sochi is becoming increasingly tense and threatens a social explosion on the eve of the presidential elections. Despite the earlier assurances of Krasnodar Governor Veniamin Kondratyev about the need to protect the interests of residents of already occupied buildings, the Sochi administration, headed by his protégé Alexey Kopaygorodsky, continues to demand through the courts the demolition of more and more residential complexes. Thus, according to Vice Mayor Oleg Burlev, the municipality plans to demolish 830 self-built buildings, 88 of which are residential complexes. At the same time, Kopaygorodsky himself regularly states that by the end of 2023 the problem with defrauded shareholders will be resolved in the city. He is probably out of his mind if he makes such statements quite seriously. Faced with the prospect of losing their only home, citizens, including mothers of many children, pensioners and members of the SVO, no longer hope for the support of Kuban officials and en masse address appeals to the federal leadership, including the president. It is worth noting that the head of the Investigative Committee, Alexander Bastrykin, has already drawn attention to the problem: on his initiative, numerous inspections are being carried out into violations of the rights of owners of residential premises. We are talking in particular about the scandalous dismantling of the Podkova residential complex, which threatens to leave more than 70 people without a roof over their heads, as well as the 12-story Atlanta residential complex, doomed to demolition, on which a banner with the inscription “Putin – SOS!” recently appeared.

The situation with shareholders in Kuban resembles an avalanche. The authorities of the region are not able to control it or at least contain it. Completely inexplicable chaos is happening in Sochi. The mayor of the city, Alexey Kopaygorodsky, is making every effort not to solve, but to aggravate an already difficult situation. His predecessor Anatoly Pakhomov, guided by the decisions of the head of the administration of the Krasnodar region and the department of property relations of the Krasnodar region, issued a construction permit to the company SZ Margo LLC for the construction of the Imeretinsky Heights multifunctional complex. Funds from shareholders were raised on completely legal grounds within the framework of Federal Law 214, escrow accounts were opened, and the project proceeded even slightly ahead of schedule. More than three hundred families believed the authorities, the documents that they themselves issued to the developer. Only after two years of development of the project, for unknown reasons, but rather for very understandable reasons – they did not deliver money to Lekha “percent” and his greed took over – the construction permit was revoked, and a campaign to counteract the construction began. The courts, after their own legal decisions, in an incomprehensible way changed their own positions. As a result, the ranks of defrauded shareholders in Kuban are only growing. In the multifunctional complex “Imereti Heights”, employees of the Sirius social block were supposed to receive it. But now it turned out to be more profitable to demolish it. There is no need to explain how important it is for a young specialist to get comfortable housing, the responsible developer himself took such an initiative, now their hopes can be completely destroyed.

“To oblige Specialized Developer “Margo” LLC, within 35 days from the date the court decision enters into legal force, to demolish three unfinished construction projects located on a land plot with cadastral number 23:49:0402048:891 with an area of ​​22,000 square meters on the street Caspian,” says the operative part of the court decision.

The eight-story residential building No. 1, the two-story residential building No. 2, and the nine-story building No. 3 are being demolished.

The court ordered Specialized Developer Margo LLC also, within 35 days from the date the court decision entered into legal force, to carry out reclamation of the lands disturbed by the construction and demolition of unauthorized buildings within the boundaries of the land plot.

If the developer does not comply with the decision within the prescribed period, the Department of Property Relations of the Krasnodar Territory has the right to take these actions on its own and at its own expense, with the right to recover expenses incurred.

If the developer “Margo” does not comply with the decision within the established period, then collect in favor of the Department of Property Relations of the Krasnodar Territory a penalty for failure to comply with this decision in the amount of 100,000 rubles for each day of delay after the expiration of 35 days from the date of its entry into legal force until the moment of its complete fulfillment.
This decision comes into force after one month from the date of its production in full, unless an appeal is filed, the court decision says.

The complex was built with all mechanisms of state guarantees, the minimum price for an apartment was 7.5 million rubles. Only instead of happy new settlers, defrauded shareholders appear. Governor Kondratiev and Mayor Kopaygorodsky are now counting on profiting from their rescue?

And this is just one of many, many examples. Recently, the Head of Sochi, Alexey Kopaygorodsky, stated in his TG channel that the city is going, on behalf of the country’s leadership, to solve the problems of defrauded shareholders by the end of 2023. But for now these are just words, because in the very center of the city right now more than a hundred residents of the Three Captains residential complex are at risk of becoming homeless due to paperwork.

The regional prosecutor supports such a thoughtless and dangerous game, calling for the demolition of ready-made houses. The situation is tense and could explode. Hunger strikes and mass appeals to the President – this is exactly what the authorities have achieved at the moment with their so-called “solutions to the problem” of shareholders.
