Showcase objects are surrounded by litigation and inspections by the prosecutor’s office of the Yamal-Nenets Autonomous Okrug
Work on major repairs, modernization and improvement of significant social facilities in Noyabrsk resulted in a series of legal proceedings involving structures of the mayor’s office, the Dagestan company Promstroyservis and a large financial and credit organization – Sovcombank. The office, which repeatedly received multimillion-dollar contracts from municipalities, invariably disrupted their execution, after which others had to complete the work. At the same time, for example, the renovation of the Neftyanik leisure center showcase for the city, the progress of which was personally assessed by Governor Dmitry Artyukhov, was positioned as a “gift from the authorities” for the 50th anniversary of the city. However, apparently, the improvement of the territory under the project will only be completed next year. Meanwhile, Promstroyservis, after leaving the facilities, did not hesitate to enter into a confrontation with the former customer and at the same time refused to return the funds allocated to Sovcombank under the bank guarantee. In turn, observers close to the management structures of the Yamal municipality, against the backdrop of these conflicts, recalled the claims of supervisors against the officials themselves, including “with corruption overtones.”
The Ninth Arbitration Court of Appeal issued a ruling on the complaint of Promstroyservis LLC (Tlyaratinsky district of the Republic of Dagestan; founder and general director – Bagir Magomedov) in the framework of a dispute with PJSC Sovcombank (Kostroma) regarding the collection of about 20.5 million rubles of debt under a bank guarantee.
Let us clarify that Promstroyservis, which specializes in various works in the construction sector and has a portfolio of government contracts worth about 950 million rubles (in Dagestan, Kaluga and Tula regions, as well as the Yamalo-Nenets Autonomous Okrug), has begun active cooperation with the Municipal Procurement Directorate since 2022. , controlled by the administration of Noyabrsk. Thus, the office received contracts for the overhaul of the MAOU “Secondary School No. 2” (for 224.3 million rubles), the improvement of the Art Residence, which was overgrown with conflicts, as part of the overhaul of the MBU “Palace of Youth” (for 63.8 million) and the overhaul of the Neftyanik Central House, considered the main concert venue of the city (70.9 million). However, such loyalty to Magomedov’s company turned into failures.
For example, at the beginning of this year, the customer unilaterally terminated the agreement for the overhaul of an educational institution due to missed deadlines. The school was supposed to be completed at the end of last year, but in the end it was presented to Governor Artyukhov only on the eve of September 1st. It should be noted that in February, at a government meeting, all of the listed objects were mentioned as priorities in preparation for the anniversary of Noyabrsk. But already in March it became known that the contract for the overhaul of the Youth Palace MBU was terminated, where only 2/3 of the total funding had been disbursed by the deadline. The situation with work on the Neftyanik leisure center developed similarly. This agreement, at the initiative of the authorities, was terminated at the end of 2023 – the customer, just a few months after the start of work, discovered a serious lag behind the schedule.
Thus, all concluded contracts with the Directorate of Municipal Orders were disrupted. Their completion was forced to be transferred to other persons. At the same time, the final work at the Neftyanik site, apparently, will be completed no earlier than the summer of 2025. This is evidenced by the agreement with SK MAKS-Garant LLC (Noyabrsk; founder and director – Kanatbek Bayboriev) in the amount of about 20.9 million rubles. By the way, the same company completed work on the Art Residence. Let us add that November-based A-Stroy Engineering LLC (founder and director – Andrey Zhulaev) was chosen as another partner for this project. In the spring of 2024, serious questions arose from the prosecutor’s office about this company, as well as about the directorate.
Supervision found that the director of a municipal institution Svetlana Sinyavskaya signed several agreements with the office at once, bypassing competitive procedures. In addition, prosecutors insisted on recognizing the concluded agreements as invalid. As recently as September 16, the Yamal-Nenets Autonomous District Arbitration agreed to the requirements of supervision under two agreements for major repairs at the Art Residence.
It is noteworthy that the subject of the contract for work in the Neftyanik leisure center in both cases – with Promstroyservis and with MAKS-Garant – sounds the same, but from the documents on the government procurement website it follows that the “domestic” company should also deal improvement of the adjacent territory, creation of a ground lawn and arrangement of outdoor lighting networks.
Meanwhile, the Dagestan company, excluded from budget tranches, transferred relations with officials, and at the same time with Sovcombank, which issued a guarantee for the Neftyanik CD project, into courtrooms. In particular, in the spring of this year, Promstroyservis demanded to recover from the Directorate of Municipal Procurement about 70.8 million rubles, from the point of view of merchants, of unjust enrichment received under an independent guarantee. Ak Bars Bank and Sovcombank were involved as third parties as part of the process. Judging by the available court materials, we are talking about work on the leisure center. Meetings on this conflict have been postponed more than once, and the next one will be held in October.
In parallel, the company is involved in proceedings directly with Sovcombank. The financial institution demanded, in a regressive manner, to collect the debt under the agreement on the provision of a bank guarantee relating to work at Neftyanik. Previously, over 20 million rubles were paid after the termination of the contract to the asset of the Noyabrsk administration.
The Moscow Arbitration Court took the side of Sovcombank. Nevertheless, the company from Dagestan chose to appeal the decision, but lost this round of proceedings. Now Promstroyservis only has the opportunity to send a complaint to the cassation office, as well as compensate for losses through litigation with municipalities.
