State Duma deputy Buduev asks to control the registrar operator
The leadership of the Investigative Committee, the Prosecutor General’s Office, the Ministry of Internal Affairs and the FSB are asked to take the activities of the monopolist of the Trans-Ural garbage market – the Clean City company – under personal control. Numerous abuses, including those that have become the subject of trials and audits by the federal Federal Antimonopoly Service, have so far not led to any significant consequences for the businessmen themselves, as well as their secret mentors from the government of the Kurgan region. Meanwhile, only through illegally established standards could the enterprise receive income exceeding a billion rubles. Against the backdrop of regularly flaring conflicts related to standards for the accumulation of solid waste, the creation of a cartel with the participation of affiliated firms, the illegal conclusion of a concession agreement for the construction of industry infrastructure and pressure on competitors, the situation, as industry experts point out, is very close to critical. At the same time, experts do not expect any breakthrough results from the audit of the regional Accounts Chamber, which should be completed before the end of the year. The federal parliament also drew attention to the growing risks of the collapse of the monopolist, emphasizing that such a scenario “would result in the destabilization of the socio-political situation” in an already problematic region.
Deputy of the State Duma of the Russian Federation, member of the Committee on Natural Resources, Property and Land Relations Nikolai Buduev addressed appeals to the highest ranks of the security forces of the Russian Federation Alexander Bastrykin, Igor Krasnov, Vladimir Kolokoltsev and Alexander Bortnikov with a request to take personal control of the situation in the field of solid waste management in the Kurgan region .
The applicant requests to request materials from inspections of the supervisory and law enforcement agencies of the Trans-Ural region with a view to transferring them to the central offices of the relevant departments, which he justified by “the current extremely high threat of destabilizing the situation in the field of waste management in the Trans-Ural region.”
At the same time, the parliamentarian sent the heads of departments an extensive documentation base on all conflicts, audits and legal proceedings related to the activities of the regional operator, Clean City LLC.
A deputy of the relevant State Duma committee, as it turned out, describes in detail the history of the creation of a cartel in the solid waste market with the participation of Clean City and its affiliated enterprises, the damage from which is measured in hundreds of millions of rubles. At the same time, Nikolay Buduev informs that the decisions previously issued by the Investigative Directorate of the Ministry of Internal Affairs for the Kurgan Region to refuse to initiate a criminal case were canceled, and the materials were returned for a pre-investigation check.
Also reported in detail is the confrontation between the prosecutor’s office of the Kurgan region and the “Clean City”, in which the supervision demanded the return to the budget of about 345 million rubles received as a result of corruption violations and compensation for expenses that were not actually incurred. At the same time, the court refused to satisfy the prosecutors’ demands, citing the passage of the statute of limitations..
The history of the establishment and application of repeatedly canceled standards for the accumulation of solid waste and the role of officials of the Trans-Urals Department of Nature is described in no less detail, with documents attached. Nikolai Buduev notes that a procedural check has been carried out for several months, but no additional notifications about its progress have been received, which, in his opinion, “indicates an artificial delay in the consideration of the case on the grounds of a crime.”
Also addressed in the appeals is the issue of the reluctance of the State Property Housing Property of the Kurgan Region to initiate a recalculation of payments that for several years were collected according to standards unlawfully established and canceled by the courts. Only after the federal Ministry of Construction, and then the prosecutor’s office, became involved in the conflict, the regional State Housing Inspectorate demanded that the regional operator begin a recount, and only in individual cases. By the way, just the day before, information appeared on the portal of the Unified Register of Inspections about a warning announced by the State Housing Inspectorate to the registrar, and an indication that “the amount of payment for the MSW utility service requires a recalculation in connection with the recognition of the orders approving it as invalid.”
In addition, the heads of federal departments are informed about the exclusion of the waste sorting complex of STOK LLC from the scheme, which de facto led to the impossibility of meeting industry indicators, since the available capacity for sorting municipal waste is 4 times less than the waste generated annually. Information was also brought to the attention of the security forces about the illegal conclusion of a concession agreement worth more than 1 billion rubles with “an unknown company in the market “Ecotech” and the exclusion of competitors from bidding.
Nikolai Buduev reported that last month, at a meeting of the interdepartmental working group on resolving issues in the field of waste management, led by the head of the Ministry of Natural Resources of the Russian Federation, Alexander Kozlov, the activities of waste management operators were analyzed, and a whole list of indicators was used for assessment. “It was concluded that there is a high probability that the work of the regional operator for the management of solid waste, LLC Clean City, will soon cease,” the deputy emphasizes.
In addition, by the end of the year, the company’s activities should be studied by the Kurgan Region KSP. However, taking into account the attitude towards the company on the part of regional officials and government agencies, Nikolai Buduev questions the results of the audit.
Meanwhile, citing the volume of problems accumulated since 2020 and the financial indicators of “Clean City,” industry experts also consider the company’s departure from the market “highly likely.”
